1. Service Description

Ace is an AI-powered voice and text receptionist platform for businesses, operated by Montclair Holdings & Co. Our service answers incoming calls, captures leads, schedules appointments, and sends follow-up messages on behalf of subscribing businesses.

2. Pricing & Payment

• Monthly subscription: $300/month per business
• First month free: All new clients receive their first month at no charge
• No contracts: Month-to-month billing with no long-term commitment
• Payment: Billed monthly in advance. Failure to pay may result in service suspension

3. Acceptable Use

Ace is intended for legitimate business use only. You agree not to:

• Use the service for any illegal, fraudulent, or harmful activity
• Send spam or unsolicited messages through our platform
• Misrepresent the nature of your business or services
• Attempt to reverse-engineer, tamper with, or disrupt the service

4. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Ace may experience downtime for maintenance, updates, or due to factors beyond our control including third-party service outages (Twilio, Retell AI). We are not liable for any losses resulting from service interruptions.

5. Call Recording

All calls processed through Ace are recorded for lead capture, appointment scheduling, and quality assurance. It is your responsibility to ensure compliance with local and state call recording laws, including any required disclosures to callers.

6. Limitation of Liability

Ace is provided "as is" without warranties of any kind, express or implied. Montclair Holdings & Co. is not liable for:

• Missed calls, incorrect transcriptions, or AI errors
• Lost revenue or business opportunities resulting from service issues
• Any indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid for the service in the preceding month.

7. Cancellation Policy

• You may cancel your subscription at any time — no questions asked
• Cancellation takes effect at the end of the current billing period
• No refunds are issued for the current billing period after cancellation
• Upon cancellation, your phone number will be released and AI receptionist services will stop

8. Data & Privacy

Your use of Ace is also governed by our Privacy Policy. Lead data is stored permanently and is never deleted to ensure complete business records.

9. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in the courts of York County, Pennsylvania.
